Ex- NBSZ employee arrested for defaming Justice Smith

NBSZ is headed by retired High Court Judge Justice Lesley Smith.
Masvikeni is also accused of discrediting the organisation.
Although no comment could be obtained from police yesterday, in his statement to the police recorded at Harare Central, Justice Smith alleged that Masvikeni defamed him through emails sent out to 154 partners of NBSZ.

The emails had a newspaper article, which purported that the retired judge was involved in a US$1 million scam.

Justice Smith mentioned several other defaming newspaper articles instigated by Masvikeni dating back to February 2012.

“I hold high esteem as I have been a judge of the High Court for 19½ years and before that I was Secretary to the Cabinet in the Prime Minister’s Office from 1979 to 1983. The article is highly defamatory of me alleging that I was part of a “scam”. As a person of high esteem I have a reputation to maintain,” reads the retired judge’s statement.

Masvikeni is expected to appear in court today.
Meanwhile, the dismissed NBSZ board had recommended the resignation of the organisation’s chief executive Mr David Mvere following two similar reports produced by different audit firms.
The reports unearthed a number of administrative and financial irregularities by the organisation’s top management.

The Herald further established that the dismissed, Parirenyatwa Hospital chief executive Mr Thomas Zigora, blood donor Mrs Christian Shaamano, Association of Health Care Funders of Zimbabwe chief executive Mrs Shylet Sanyanga and National Aids Council finance director Mr Albert Manenji comprised the human resource and finance committee.

The committee instigated the forensic audit and subsequent recommendations.
It has been established that the committee further asked NBSZ management to produce a detailed plan for the correction of problems found in the forensic audit by the end of December 2012.
The dissolution was done barely a month after the recommendations were made.

However, NBSZ spokesperson Ms Esther Massundah dismissed allegations that the members were being victimised.

She said the dissolution was a restructuring exercise within the organisation.
Ms Massundah said it was noted that the board was not properly constituted and well represented hence the decision to dissolve it.

She said some of the members were co-opted into the board a long time ago and they needed new skills and ideas to the organisation.

“The dissolution of the board was done last year following amendment of the articles that govern NBSZ operations at the AGM,” she said.

The AGM was held on November 28 last year.
She said some members were NBSZ clients hence were not fit to be in the board as it would create a conflict of interest.

“We now have a new board, comprising of blood donors and we will soon announce it.
“It comprises of representatives of blood donors from all the provinces and the vetting process is still taking place,” Ms Massundah said.
