Families seek to unseat chief Mashayamombe

First to file an application is Emmanuel Mufuka who cited Local Government, Rural and Urban Development Minister as the first respondent, the provincial administrator, Chegutu district administrator and Chief Mashayamombe as second third and fourth respondents respectively.

Mufuka argues that the customary principles of the Mashayamombe community were not followed as the incumbent chief did not belong to a chieftainship family.
Another applicant Chamunorwa Kaseke, who also cites the four argues that the Chiketa family who are descendants of Mpakairi have never taken part in the chieftainship of the Mashayamombe clan save as sub-rulers. The third applicant Paul Guvaza is also challenging the installation of Chief Mashayamombe saying his appointment was without the mandate of the Mashayamombe people.

However through his lawyer Mr Clever Mtisi, the chief argues that he was properly installed and that Mufuka himself did not qualify to be appointed chief since his grandfather Tara refused to rule and selected his young brother to rule on his behalf. The matter is still to be heard.

Kaseke, who is being represented by Hangazha and Charamba law firm, also argues that the chiefs’ nomination was unprocedural as he was not from the Mashayamombe lineage.

Chief Mashayamombe, however, argues that the relief sought was not practical since he had been inaugurated. He also argues that the court did not have power to interfere or inquire into the President’s powers to appoint chiefs.
