Family land sold for $200

A MUTASA man who sold his land to another family a decade ago has been hauled before the courts for harassing them in his bid to get the land back.

Chipo Gore has since applied for a peace order against Themba Sibanda due to his endless threats and insults.

Mutare magistrate, Mr Xavier Chipato granted the peace order in Gore’s favour.

The order bars Sibanda from harassing, insulting and threatening Gore’s family.

Gore said Sibanda sold some land to her family on May 4, 2012.

However, he is now trying to evict them from the property which they have developed over the years.

“Sibanda is causing havoc at our home. He is always making unannounced visits as he tries to evict us.

““He insults us with vulgar language, harasses the children and threatens us with death.

“He sold this land to us for US$200, but now he is denying that. After the payment, we also got the village head’s blessings to occupy the land.

“My brother left for South Africa, thereby leaving me in charge of the property,” said Gore.

However, Sibanda denied ever selling the land to anyone.

He said he was surprised to see Gore and her children occupying part of his land.

“I returned home from where I was working in 2013 and was surprised to see Gore and her children occupying part of my land, claiming that I had sold it to them, yet I had not.

“I asked her to leave, but she refused, telling me that her brother was the one who had bought it. She said she would only leave after her brother’s return from South Africa and a refund of the money used in acquiring the property.

“I have never insulted, harassed or threatened her with death.
“Her brother fled to South Africa soon after I had asked him for a meeting to solve the issue,” said Sibanda.

Gore said the local leadership showed her an agreement of sale between Sibanda and her brother confirming the sale.

The document was also produced before the Mutare court.
