Fired manager loses appeal

against constructive dismissal at the Labour Court.
Othiniel Mushangwe was charged and subsequently found guilty of unsatisfactory work performance and seriously disadvantaging the company financially due to failure to carry out duties as assigned.
A penalty of dismissal with effect from July 8, 2009 was then imposed and Mushangwe appealed to the respondent’s appeals committee.
The appeals committee confirmed his conviction on the charge but however reduced the penalty to that of final written warning.
Mushangwe was reinstated by way of a letter dated July 23 2009, but was to reimburse the respondent for financial loss suffered.
