Football’s test case gathers momentum in Kenya

NAIROBI. — The Kenyan Government’s probe into their football governing body has gained momentum, with the investigating team demanding a number of documents, which have to be delivered by today.

The comprehensive audit into the Kenya Football Federation is being viewed as a test case, by many African governments, who have been concerned about making similar moves, because of the possible sanctions, which could come from FIFA. Three FIFA officials are currently in Kenya to help deal with the challenges facing the game in that country.

Kenya’s Sports Cabinet Secretary, Amina Mohamed, ordered the Sports Registrar to audit the FKF accounts and other matters of interest.

Her directive came after the High Court of Kenya cleared the path for the Directorate of Criminal Investigations and the Director of Public Prosecutions to investigate FKF president, Nick Mwendwa, over suspected misappropriation of funds at the association.

On Sunday, Mike Komoko, the head of the KFK Inspection Committee, wrote to the federation’s chief executive, Barry Otieno, requesting a number of key documents.

‘’Pursuant to the directive, the Sports Registrar on 18th October 2021, appointed inspectors (Inspection Committee) to undertake the exercise with the following Terms of Reference.

  1. Identify areas of non-compliance to the Sports Act and any other relevant law including submission of Annual Returns and other relevant documents to the Ministry.
  2. Scrutinise FKF books of records, accounts and expenditure alongside the Kenya Constitution 2010 Public Management Finance Act, Public Procurement and Asset Disposal Act 2015 requirements to establish whether there has been any misappropriation of funds advanced to FKF by the Government, and any international or national organisation or person, among others and
  3. Prepare an inspection report and submit to the Cabinet Secretary, within two weeks, from the date of appointment.’’

Komoko then came up with a list of demands.

“Following the Cabinet Secretary’s directive that an inspection of FKF be undertaken, in accordance with the Sports Act and subsequent appointment of the inspectors, the Inspection hereby request you to submit certified copies of the following documents for the period between 1st July 2014 to date on, or before, the 28th day of October 2021, to enable the Inspectors to execute their mandate:

  1. Current FKF Constitution.
  2. FIFA and CAF Statutes.
  3. KFK Registration Certificate(s)
  4. Licences to referees, coaches and athletes.
  5. List of registered Sports Organisations (country football sports associations and clubs, including Premier League, nationwide and Super League) affiliated to FKF and their registration certificates.
  6. List of registered members, national officials/governing council members, athletes and technical officials.
  7. Identification documents i.e Identity Cards and phone numbers of staff members, national officials/Governing Council members, athletes and technical officials.
  8. Contracts of engagement of coaches, referees and staff.
  9. Master payroll.
  10. Proposals and requests for funding.
  11. List of all projects undertaken and the respective project implementation status.
  12. Records including but not limited to contracts relating to funding of FKF by the Government, FIFA, Odibet, Multichoice, amongst other donors.
  13. Grants and donations, both development and recurrent, from Government, Non-Governmental organisations and individuals.
  14. Grants and donations from international organisations like Multichoice, FIFA, Odibet and CAF.
  15. Exchequer releases.
  16. Expenditure returns and reports relation to funds received from the Government, various organisations and individuals.
  17. Internal and external audit reports.
  18. Approved budgets.
  19. List of bank accounts held by FKF.
  20. Authorised signatories to the FKF Bank accounts and the mandate.
  21. Bank statements.
  22. Bank reconciliation statements
  23. Cheque counterfoils.
  24. Cashbooks.
  25. Payment vouchers properly grouped as per the voted provisions.
  26. Imprest files and registers
  27. Asset register
  28. Strategic plans
  29. Procurement plans
  30. Tender documents, including but not limited to BQS, registers, list of prequalified tenderers and minutes relating to procurement.
  31. Annual financial statements.
  32. Annual inter-entity reconciliation.
  33. Annual returns and
  34. Documents relating to internal reporting mechanism (Finance, FKF Organisational Structure).

“The documents should be submitted to the Sports Registrar’s Office at NSSF Building, Block ‘A’ Eastern Wing, 24th Floor within the days specified herein above.’’ — The Standard/Sports Reporter.
