A Form Four pupil at Bulawayo’s Sobukhazi High School has appeared in court facing charges of breaking into her boyfriend’s house and tearing his passport.The court was told that the 19-year-old pupil, name withheld for legal reasons, wanted to fix Mr Farai Phiri, a commuter omnibus driver for cheating on her.
The two told the court that they have since called off the affair because of the incident.
The pupil pleaded guilty to a count of forcibly gaining entry into another person’s house and malicious damage to property when she appeared before Bulawayo provincial magistrate Mr Abednico Ndebele.
She was lucky to escape jail life after the magistrate warned and discharged her.
The magistrate told her that “we will not forget that you were in this court.”
This was after her lawyer, Mr Costa Dube, of Mcijo, Dube and Partners submitted that she would not be able to pay a fine or replace the passport because she was still at school. Mr Phiri, age not given but residing at 13 Northway in Burnside, told the court that he wanted her to replace his passport because he could no longer use it.
The pupil, who resides in Hillside, said she tore two pages from Mr Phiri’s passport because they had agreed that she would “do anything” to him if she caught him with another woman. “He broke my virginity when I was in Form Two when we had sex and we made an agreement that if I caught him with another girlfriend, I would do anything to him,” she told the court.
Asked by the magistrate why she allowed Phiri to have sexual intercourse with her when she was still a minor, the pupil said he had promised her “heaven on earth.”
The State’s case was that on 7 August, the pupil went to Mr Phiri’s house and gained entry through a window.
While inside, she took his passport and tore off two centre pages which she destroyed.
A report was made to the police leading to her arrest.
