Former magistrate in court for using Dr Makamba’s name, property to defraud businessman

Former Bindura magistrate Edith Kakuruwo appeared at the Bindura Magistrates’ Court on allegations of defrauding a businessman of over US$3000 using Senator James Makamba’s name and an agreement of sale for his residential stand.

She appeared before Provincial Magistrate Mr Tinashe Ndokera with her co-accused, 58-year-old Elvis Muzavazi.

Prosecutor Mrs Getrude Mayenyeso told the court that Kakuruwo, who resides in Chiwaridzo, and Muzavazi, from Mupandenyama in Bindura, were both employed by Thurlow and Company owned by Dr Makamba.

Kakuruwo was an administrator during the commission of the alleged crime. The complainant in this case is Robson Mabhengo, a 45-year-old shop owner in Bindura.

It is alleged that on November 28, 2022, Kakuruwo received an agreement of sale for stand number 2260 CBD Bindura from Dr Makamba, the director of Thurlow and Company.

On January 7, 2023, around 9 am, Kakuruwo and Muzavazi, acting in connivance with an accomplice named Florence Makubaza, who is currently at large, approached Mabhengo with the agreement of sale for stand number 2260 CBD Bindura and falsely claimed they were sent by Dr Makamba to borrow US$3 380.

They indicated that the agreement of sale was the collateral. Mabhengo agreed and gave them the money.

On April 7, 2023, Mabhengo approached the accused intending to see Dr Makamba to discuss the late payment of the loan, but they allegedly denied him access.

On May 6, 2023, Mabhengo contacted Dr Makamba, who denied ever sending anyone to borrow money on his behalf.

Realising he had been deceived, Mabhengo filed a police report.
