seeking acquittal without getting into the defence case. Justice Chinembiri Bhunu reserved ruling on the application after hearing arguments from both the State and the defence lawyers.
In the application, Ms Mtetwa argued that the police investigations were poor and no evidence was linking the 29 suspects to the commission of the offence.
She said the police decided to politicise the case instead of investigating to establish the real culprits.
Ms Mtetwa said there was no need for the suspects to be placed on their defence. She argued that the identification of some of the suspects by single witnesses lacked corroboration and that it should not be accepted by the court.
The State witnesses’ evidence was riddled with inconsistencies and different versions of one incident were given to the court, she said.
However, law officer Mr Edmore Nyazamba opposed the application arguing that the State had established a nexus between the 29 suspects and the commission of the offence.
Mr Nyazamba said the evidence showed that the 29 were part of the MDC-T supporters who were gathered in Glen View for the MDC-T T-Shirt Visibility Day function.
The group, according to Mr Nyazamba, was the one that later attacked the police and killed Insp Mutedza.
