Shingirai Mudzingwa (27) had pleaded not guilty to murder but was on Wednesday convicted of murder with constructive intent by Justice Ndou sitting with assessors Messrs Jameson Lex Dhlula and Wellington Takawira Matemba. The court found extenuating circumstances in that he had been found guilty of murder with constructive intent.
Mudzingwa was represented pro deo by Mr Manners Jaravaza, of Dzimba Jaravaza and Associates.
For the State, Mr Tafadzwa Mpariwa said on 11 February this year at around 8pm, Mudzingwa and the now deceased Elijah Marumbwa went to Bonnyvale Farm bar for a beer drink as well as watching a soccer match.
Mr Mpariwa said after the bar had closed, Marumbwa and one Mr Robson Muhwandagara, who were also watching the soccer match, left the bar for their respective homes. The court heard that while on the way home, Mudzingwa started arguing with Marumbwa over the match. Mr Mpariwa said a fight later broke out between the two.
During the fight, Mudzingwa picked up a stone and struck Marumbwa once on the face resulting in him falling to the ground. Mudzingwa then left Marumbwa lying helplessly on the ground and proceeded to his home, the court heard.
Mr Mpariwa said a passerby discovered Marumbwa’s body the following morning.
Investigations by the police resulted in Mudzingwa’s arrest.
