HMMAS agrees to pay Kereke US$60 000

THE Harare Municipal Medical Aid Society has conceded that it owes Dr Munyaradzi Kereke an outstanding balance of US$60 000 on the Fortress Hospital deal.

In a deed of settlement signed between HMMAS and Dr Kereke on 16 April 2026 which was registered at the High Court, HMMAS also cleared Dr Kereke of any wrong-doing in the transaction.

The medical aid society had previously alleged that Dr Kereke had defrauded it of US$138 000 in the transaction.

Under clause 26 (e) of the deed of settlement, parties agreed that “the consent of the parties hereto has been informed, free and voluntary and may not be vitiated by allegations of lack of authority, undue influence, fraud, duress, misrepresentation or any other justifiable cause whatsoever”.

Under High Court case number R-HCHC745/23, HMMAS had sued Dr Kereke claiming US$138 000 from him on an allegation of fraud in the transaction in which the medical aid society bought Fortress Hospital from him in 2014.

In an out of court settlement, HMMAS relented and conceded it instead owed Dr Kereke US$60 000 as the outstanding balance for his Fortress Hospital which he had sold to the medical aid institution.

“In full and final settlement of all claims, disputes, causes of action, counter claims, and demands of whatsoever nature arising between the Parties, including but not limited to the claims in case number R-HCHC745/26, case number HCH320/26 and case number HCHC45/26, the plaintiff (HMMAS) agrees to pay to the First and Second Defendants (Dr Kereke and his company Briward Trading (Private) Limited) the aggregate sum of US$60 000, hereinafter referred to as the settlement amount,” reads clause 11 of the deed of settlement.

Harare High Court Judge Justice Siyabona Paul Musithu endorsed the settlement through a court order  on 29 April 2026, putting an end to the long-standing dispute.

“The deed of settlement signed and executed by parties on 16 April 2026 and filed of record is hereby incorporated as part of this order”, said Justice Musithu.

When reached for comment on this development, Dr Kereke confirmed the  settlement.

“Yes I can confirm that all the material disputes of fact that were before the High Court between myself and HMMAS have been resolved amicably. They had sued me and I counter-claimed against HMMAS rebutting its allegations against me and I demanded my money based on facts.

“We have now found each other. HMMAS has already started paying my US$60 000.00 balance as mutually agreed to by parties. Fortress Hospital is now properly theirs. I am very pleased with this outcome at the High Court. God is great” said Dr Kereke.
