THE Mutare Civil Court was brought to a standstill last week after a Marange man protested against paying $40 maintenance, saying he had sold all the cattle he had, thereby left with no other source of income.
While court business is usually conducted in a serious manner, everyone in the gallery was left in stitches with Nyasha Mupombwa’s antics as he desperately tried to convince the court that he had hit hard times.
He was praying for downward maintenance variation from $40 to $20 for the child that he sired with Tsitsi Changadzo.
The two appeared before Mr Poterai Gwezhira.
Mupombwa told the court that the car that he was using to generate money after sacrificing his 10 beasts to maintenance payment broke down, so he could not continue paying the $40.
“I have nothing left on me Your Worship. The car that I have been using as a pirate taxi after selling my cattle is down,” said Mupombwa.
Mupombwa told the court that he also had two other children and a wife to take care of.
“I also have a wife and two other kids to take care of, so I can now afford $20 only,” he said.
Asked whether she agreed to what her ex-hubby was saying, Changadzo felt pitiful for the father of her child and agreed to receive the $20.
“I am aware that the beasts are gone and the pirate taxi is now down. He is struggling. The $20 is still fine,” said Changadzo.
She told the court that Mupombwa had not been paying enough money over the past few months and he owed her a balance of $120.
In his ruling, Mr Gwezhira said: “Changadzo understands your situation, but $20 is too little for the child’s needs and therefore I order you to pay $30 with effect from August 31.”
He also advised the two to discuss on how Mupombwa would pay the $120 that he owed his ex-wife.
