‘I am failing to fend for myself’

FAILURE to comply with maintenance orders landed a Mutare man in trouble after he was dragged before the courts for defaulting. Paris Zimunya (34) of Matika Village under Chief Zimunya was on Monday convicted on his own plea of guilty to failure to comply with a maintenance order as defined in Section 24 of the Maintenance Act Chapter 5:09.

He appeared before Mr Langton Mukwengi. Prosecuting Mr Fletcher Karombe told the court that on February 7 2015, Zimunya was ordered at Mutare civil courts to pay $20 per month as maintenance for the child he sired with Nyarai Munyu.

“However, Zimunya acted unlawfully and did not pay a cent since the date of ruling. He is in arreas of $640,” said Mr Karombe. In his defence, Zimunya told the court that he was struggling even to fend for himself.

In his ruling, Mr Mukwengi ordered Zimunya to pay the $640 maintenance areas before January 10, 2016. Failure to pay will lead to his incarseration for 90 days.
