The fraud trial of George Katsimberis continued yesterday with him saying the plan being used by the State in charging him was not his.
Katsimberis who is demanding the State to furnish him with further particulars said the State was failing to give him the particulars because the plan which it is using to charge him was not the one which he used to build the showroom.
In the previous sitting, his lawyer was advised by the court not to make a plethora of requests before the application for referral to the Constitutional Court was completed.
Advocate Tinomudaishe Chinyoka had requested the court to help his client by accessing some missing information in the transcript which he claimed would help him in his application for referral to the ConCourt.
He requested some information that was missing in the transcript which was in his possession.
Advocate Chinyoka told the court that the clerk of court must search for the missing part of the record.
However, Deputy Prosecutor General Mr Michael Reza responded by saying that the application which was being made by Advocate Chinyoka was a request for further particulars and he should approach the superior court if it is the case.
Mr Reza said when a court sits to hear an application, that court is removed from handling that application again saying no other magistrate can come and continue from where another magistrate left.
Harare magistrate Mrs Vongai Guwuriro said she felt the defense was now detaining the court with such requests.
She further told Chinyoka that he could not detain her court and asked him to stop further asking her as if he was interrogating her on the ruling she delivered saying if he did not understand her ruling he must get a copy and re-read.
