A Harare law firm and its clients have withdrawn their lawsuit against the owner of Rock Foundation Medical Centre, Dr Munyaradzi Kereke, after the businessman filed a complaint with the Law Society of Zimbabwe against two lawyers he accused of unethical conduct.
Musoni Law Chambers was representing nearly 100 workers who wanted to place Dr Kereke’s hospital under provisional judicial management claiming it had failed to pay creditors US$5 million.
After filing their application at the High Court, Dr Kereke – who is also legislator for Bikita West – filed a complaint at the LSZ against lawyers Ms Monica Jera of Mpame & Associates and Mr Kevin Musoni of Musoni Law Chambers of improper conduct.
In a notice of withdrawal filed at the High Court on Monday, Musoni Law Chambers advised that “applicants hereby withdraw their claim against the respondent in this matter”.
They offered to pay costs of litigation.
Dr Kereke on Tuesday welcomed the law firm’s decision to withdraw the claim.
“We welcome the noble decision by the law firm and its clients to respectfully withdraw their mischievous court application,” said Dr Kereke.
“Without doubt they were on the verge of getting serious sanctions from the country’s judicial system against the background of the blatant fraud they had sought to commit.”
In his complaint to LSZ, Dr Kereke alleged that Ms Jera fraudulently commissioned 89 forged affidavits filed at the High Court under case number HC4425/ 14.
In respect to Mr Musoni, Dr Kereke said the lawyer filed the 89 fraudulent affidavits and fabricated financial records of RMC.
Dr Kereke said by claiming that 89 affidavits were before her and proceeding to certify them, Ms Jera abused the Commissioner of Oaths powers because the 89 affidavits were fraudulently drawn and not signed by the purported RMC Hospital employees
Musoni was accused of filing the applicants’ affidavits at the High Court and that he also submitted to the court fabricated financial statements for the RMC Hospital, in a clear intention to cause crippling harm to the hospital, its patients and owners.
