FORMER Bikita West legislator Munyaradzi Kereke yesterday made an outrageous demand in court for Prosecutor-General Loice Matanda-Moyo to be subpoenaed to testify as a friend of the court in his fraud case.
He made the application before magistrate Donald Ndirowei.
He claims his arrest was based on a fraudulent audit report.
Magistrate Ndirowei said he couldn’t entertain the application since magistrate Marehwanazvo Gofa was already seized with the matter.
Kereke continued shouting in court that his rights were being violated and was warned by magistrate Ndirowei that his theatrics would not be entertained.
The complainant is Harare Municipal Medical Aid Society (HMMAS), which is a subsidiary of the City of Harare.
Kereke is appearing together with suspected HMMAS CEO Everisto Rukasha.
Kereke is the founder and owner of Briward (Pvt) Ltd, trading as Fortress Hospital.
The court heard that in 2014, Kereke and Rukasha agreed to enter into an agreement of sale whereby Kereke agreed to sell Fortress Hospital to HMMAS.
Kereke was allegedly paid US$800 000 and went back to make a claim that he was owed US$400 000 by HMMAS.
After being pressured by Kereke, the board initiated the payments and later realised that he had been paid his full amount and they filed a police report.
Earlier this week, Kereke made an application seeking refusal of further remand arguing that the State had no evidence against him.
He called for the court to intervene in his case because the administrative position by the State was causing the infringement of his rights.
He told magistrate Gofa that every person had a right to administrative conduct that was lawful, efficient and impartial.
He said the State’s conduct fell short of these requirements because, according to him, his arrest was unjustified.
The matter was remanded to July 8.
