Canadile Miners was a joint venture between Marange Resources and Lovemore Kurotwi’s Core Mining to extract diamonds in Marange.
It ended after some fraud accusations against Kurotwi were raised concerning the manner in which the shareholders’ agreement was signed between the parties.
This culminated in the arrest of Kurotwi, former Zimbabwe Mining Development Corporation chief executive Dominic Mubaiwa and a host of ZMDC board members who were later freed.
Kurotwi and Mubaiwa are currently on trial for allegedly defrauding the Government of US$2 billion after causing it to enter the joint venture agreement with an undeserving company, Core Mining.
According to the prosecution, Kurotwi and Mubaiwa misrepresented that Core Mining was a special purpose vehicle company of an international mining giant BSGR. It had no ties with that reputable company.
While Kurotwi was contesting an inspection in loco that was granted by the High Court to be conducted in South Africa, Core Mining took the civil case for arbitration and the Law Society of Zimbabwe appointed Retired Judge Justice Moses Chinhengo as a commercial arbitrator.
Marange Resources, through their lawyers Advocates Thabani Mpofu and Firoz Girach filed an urgent chamber application seeking to interdict Justice Chinhengo, Core Mining and the Law Society of Zimbabwe from conducting the arbitration proceedings.
Marange Resources argued that Core Mining had a pending civil case at the High Court in which it seeks to validate the shareholders’ agreement in the joint venture company.
