A land baron who is believed to be illegally parcelling out land in Masasa Park belonging to Msasa Park (Pvt) Ltd has been dragged to court in one of the numerous cases he is accused of.
In his latest brush with the law, Tawanda Jambwa and his accomplice Charity Masondo appeared before Harare magistrate Apollonia Marutya facing fraud allegations.
They were released on US$100 bail and were ordered to report once a week at CID CCD.
The complainant is Ruvimboramwari Mukuze.
Allegations are that in July Mukuze thought of purchasing a residential stand and was referred to Jambwa by his friend.
Jambwa allegedly told him that Masondo had a stand for sale in Masasa Park.
He took Mukuze to meet Masondo who confirmed that she was the owner of stand number 4747 of the remainder of stand 560 Chadcombe Township measuring 501 square metres which she was selling for US$10 000.
Convinced, Mukuze asked to view the stand and was taken to see it.
He was assured that the stand had no pending issues.
Upon viewing the stand, Mukuze was satisfied and both parties agreed that upon payment of a deposit of at least US$4500 he would take occupation of the stand.
It is the State’s case that on July 19, Mukuze paid the deposit of US$4500 to the duo and an agreement of sale was signed between him and Masondo while Jambwa acted as a witness.
On August 30, Mukuze made another payment of US$700 to which Masondo signed an acknowledgement of receipt of the money.
When Mukuze tried to occupy the stand, he discovered that it belonged to another person and verification with Msasa Park (Pvt) Ltd legal practitioners, Bruce Tokwe Commercial Law Chambers, revealed that Masondo had no claim to that stand.
Further, nothing materialized upon engaging the two who then became evasive prompting him to file a police report.
Jambwa is also implicated in similar cases involving stands in Msasa Park that are still pending.
Rufaro Chonzi prosecuted.
