Law officer Bosha off the hook

Harare regional magistrate, Mrs Marehwanazvo Gofa yesterday removed Arthur Bosha, a law officer, from remand following a review by the High Court.

Bosha was being accused of consenting to bail for armed robbery suspect Musafare Mupanhanga without consulting his superiors.

He was facing allegations of criminal abuse of office.Justice Pisirayi Kwenda’s review cited that both the standard operating procedures and the memorandum were not part of public law, and were not binding for Bosha to be properly charged with criminal abuse of duty as a public officer.

In consenting to bail, Bosha is said to have disregarded standard operating procedures of the Attorney General’s Office which dictate that applications and bail alterations should be done through the area public prosecutor or the public prosecutor in consultation with the chief law officer.

According to basic procedures laid down on November 16, 2020, all prosecutors’ consents to bail are to be approved by their superiors.

The State alleged that Bosha favoured Mupanhanga, who was part of a gang of armed robbers led by Musa Taj Abdul.
