Lawyer accused of undermining President’s office

Gift Nyandoro pleaded not guilty to the charges when he appeared before Harare magistrate, Mr Tayengwa Chibanda, who remanded him to July 26 this year for trial continuation.

In his defence outline he confirmed a misunderstanding with the then prosecutor Mrs Phyllis Zvenyika about whether a bail application should be done or an application for refusal of remand.
He, however, said the report was a clear fabrication bent on malice.

It is the State’s case that on December 15 last year Nyandoro was representing a client Yemba Pauline Mulamba.
He had an argument with Mrs Zvenyika a former prosecutor concerning an application for refusal of further remand he was intending to make.

The State says Mr Nyandoro had earlier told the prosecutor that he wanted to make a bail application before making a U-turn, saying he intended to challenge remand.
An argument arose and it is alleged that Nyandoro uttered words denouncing and undermining the Office of the President, saying that “Hazvisi zvejunta, Hazvisi zvaMugabe izvi”.

It is alleged he said the words in the presence of the court orderly constable Prince Mikambwa and detective sergeant Zvidza who was the investigating officer in the matter of Mulamba.
It is the State’s contention that Nyandoro had no right to undermine the Office of the President.
