adminlawyers’ register some 14 years ago over unprofessional conduct, says he is now completely rehabilitated and fit for re-registration as a legal practitioner.
Masimirembwa was de-registered on March 14, 1997 after being convicted of unprofessional, dishonourable or unworthy conduct by the Legal Practitioners Disciplinary Tribunal.
He was accused of failing to keep proper books of accounts and misappropriation of trust funds.
In a High Court application for restoration to the register of legal practitioners, public notaries and conveyances, Mr Masimirembwa says he had fully compensated the Law Society of Zimbabwe the money it paid to his creditors on his behalf. The application is expected to be determined in the motion court tomorrow.
Mr Masimirembwa said he had gone through a complete transformation process and that he had acquired more experience and maturity that made him wiser and more responsible.
“It is important to note that it is now more than 11 years from the date of deletion of my name from the register and more than 12 years from the date of the commission of the acts of misconduct. I have gone under complete transformation since the unfortunate time.
“My experiences since then and (the) maturity I have acquired have made me wiser and more responsible than before to the extent that I am completely rehabilitated. I aver that I am now a completely rehabilitated person and fit to have my name restored to the register. I further state that I have fully compensated the Law Society of Zimbabwe all the money it paid to my creditors on my behalf,” said Mr Masimirembwa.
Mr Masimirembwa graduated with a law degree in December 1988 at the University of Zimbabwe after obtaining a magistrate and prosecutor’s certificate in 1984. He joined Mugabe, Mutezo and Partners in January 1989 as a professional assistant and rose to become a partner in January 1991. A year later Mr Masimirembwa partnered another lawyer to form Masimirembwa, Chitiyo and Associates before moving on to form
Masimirembwa, Gula-Ndebele and Manase the same year. In May 1994 he formed his own firm Masimirembwa and Associates, which operated until he was provisionally barred from practice following reports of unprofessional conduct.
Between 2004 and 2006, Masimirembwa was attached to Musunga and Associates, where he worked under the supervision of senior partner Mr Aston Musunga. He argues that he learnt a lot from Mr Musunga as a senior lawyer and that the past experiences have made him a better lawyer.
