Madhuku clings on

congress if the Copac Constitution-making process collapses or the country holds elections under the current Constitution.

However, some NCA members accuse Prof Madhuku of hiding behind political processes to cling on to power.
“The current leadership under Madhuku is just using the referendum to cover up for their desire to cling on to power,” said a source.
“There is nowhere in the NCA constitution where it says, the NCA processes will be determined by political processes.”

Another source added: “The challenge we have now is that we don’t know when we are going to have a referendum and we can’t use that as an excuse for the NCA’s failure to do what is in the assembly’s constitution.
“There is no guarantee that we are going to have our way in terms of a ‘No’ vote during the referendum if ever it is to be held, so why shouldn’t we change the leadership?

“We are an institution that should be a proponent of reform but if we start exhibiting these tendencies then people won’t take us seriously.”

Prof Madhuku, who has been at the helm of the NCA for the past 14 years, dismissed the disgruntlement saying their term had been “legally extended”.

He said the current leadership was expected to push for a “No” vote during the new constitution is put to a referendum whose date is not yet known.
“There will be no change of leadership of the NCA as long as there is talk of a referendum to the Copac processes,” Prof Madhuku said.
