changed circumstances that warranted his release on bail.
He is being charged with murdering a police officer in May this year together with 24 other MDC-T members in Glen View.
Madzore, who has been in custody since October 4, initially had his bail application dismissed for fear that he might abscond.
He launched a fresh bail application based on what he believed to be changed circumstances.
Justice Mary Zimba-Dube found that video evidence produced in court by MDC-T through party spokesperson Mr Douglas Mwonzora to buttress Madzore’s case was heavily doctored and could not add any value to the case.
The court found that one incident purportedly recorded at a Chitungwiza rally showed October 5, 2011 as the recording date when he was actually already in police custody.
Madzore was arrested on October 4 and he could not have attended a rally on October 5 in Chitungwiza.
It was also the court’s finding that Madzore was aware of the fact that he intended to complete his studies at the University of Zimbabwe at the time of initial bail application, hence the fact that he decided not to raise it then could not constitute a changed circumstance.
The court also threw out the stringent bail conditions that Madzore proposed saying these were not changed circumstances.
Madzore had offered to be confined to 24-hour house arrest pending determination of the matter and to surrender a registration book of his car.
His brother Paul Madzore, legislator for Glen View and MDC-T spokesperson Mr Douglas Mwonzora offered US$5 000 surety each for the release of Madzore.
Justice Zimba-Dube said the court was not responsible for assisting those who will be sleeping at the time of their initial bail applications and that the bulk of the grounds relied upon as changed
circumstances were known to Madzore on his first bail attempt.
The judge said the bail application was misguided and improperly before the court.
Madzore and 24 others are being charged with murder of Inspector Petros Mutedza in Glen View when he was performing his police duties.
