THE biblical saying “an eye for an eye” rang true for a Binga man who was severely assaulted after being caught red-handed with a fellow villager’s wife.His assailants, who included the woman’s husband two brothers, walked out of the court smiling after they were set free by Binga resident magistrate Mr Stephen Ndlovu who ruled that there was gross provocation.
Blessed Moyo (26), Moses Moyo (28) and Brighton Moyo (23) brothers from Lusulu Village in Binga were being accused of assaulting Pinias Mbirarume after they found him in Blessed’s bedroom hut with his wife.
The court heard that sometime on 16 February this year at around 8pm, Mbirarume, who was having an affair with Blessed’s wife, was found holed up in the bedroom hut after being informed that Blessed was not coming back until 3am.
After catching wind of the affair, Blessed informed his brothers and the trio hatched a plan to deal with Mbirarume.
On ensuring that all exits were blocked the three who were armed with sticks began to assault Mbirarume several times all over the body fracturing his arm in the process. He made a report to the police, leading to their arrest.
The trio pleaded guilty to the charge of assault arguing that Mbirarume had provoked them by bedding Blessed’s wife in his bedroom.
“Your worship, we don’t deny that we assaulted the complainant because we had no choice. What he did was disrespectful and provoking — sleeping with our brother’s wife on his bed. May the court forgive us. We acted out of anger and provocation at Mbirarume’s actions,” Moses said.
The magistrate ruled that there was gross provocation on the part of the complainant before acquitting the three.
