A BULAWAYO man violated a court order by forcefully occupying a house he had been evicted from but was lucky to escape with a caution.Themba Maseko appeared before Western Commonage magistrate Tancy Dube charged with contempt of court.
Prosecuting Frank Ncube said Maseko violated a court order and occupied the premises forcefully following his eviction.
The man is said to be refusing to move out of the house that belongs to his former girlfriend.
“Maseko in violation of a court order issued at Tredgold court which compelled him to vacate premises impaired the dignity, reputation and authority of the court by forcefully, remaining in occupation of the premise,” he said.
Simba Maphosa, the complainant, said the house in question was her sister’s and they co-habited with Maseko before their relationship collapsed.
“This man was my sister’s boyfriend and he stayed with us in my sister’s house. They broke up long back and now he is claiming the house is his.
“He wants his ex-girlfriend to pay him for staying in her house during the time they were in love,” she said.
Maphosa also said they are still living with her sister’s ex-boyfriend but they are not in talking terms.
“Maseko is refusing to leave my sister’s house. He has been staying there since they separated with my sister. We stay in the same house but we don’t share anything. We don’t talk to each other. We cook differently but we will be in the same kitchen”, she said.
Maphosa told the prosecutor that Maseko was evicted by the police, but moved back into the house when they had left.
“This man was thrown out of the house by the police but he still came back to stay. He says he will not vacate until his ex-girlfriend pays him. He also claims he contributed the money to buy my sister’s house,” said Maphosa.
Maseko pleaded guilty to the charge and magistrate Dube cautioned him and ordered him to vacate the house immediately.
