A MAN raped his brother’s 16-year-old daughter moments after telling her that her parents were HIV positive, a court heard yesterday.
Witness Vundla, 30, of Montrose 4B Village in the Skuta area of Filabusi, waited for his victim in a kitchen hut while she was out in the fields, then gave her the alarming health news when she returned, the Filabusi Magistrates’ Court heard.
Tafireyi Smart, prosecuting, narrated how Vundla told the victim that sores on her two-year-old brother’s body were an indication that he was HIV positive.

He convinced the victim – who cannot be named for legal reasons – that the medical reports proving his claims about her parents were in their bedroom, and then led her there.

“As they were reading the cards, Vundla grabbed the victim and lifted her onto the bed. The victim screamed and tried to kick Vundla but he did not let her go,” Smart told magistrate Mzingaye Moyo.

Vundla, it is alleged, then raped the Form 2 pupil once. He warned her against reporting the attack as he left, the court was told.
Her aunt arrived home and found her crying. Later, she called her grandmother by phone and told her of the alleged sex attack and police were called.

Magistrate Moyo asked Vundla if he had anything to say to the charges, to which he replied: “I did meet the victim, but we only discussed missing goats and the sores on her brother. I didn’t rape her.”

Moyo ordered Vundla to be tested for HIV, while remanding him to January 22 to appear before Gwanda magistrates.
He also advised Vundla, who is unemployed, to apply to the High Court for bail.
