A MAN from Kadoma has appeared in court on fraud and perjury charges after he allegedly submitted a fake CR14 and opposing affidavit at the High Court, leading to the informant in the case being prejudiced of US$3 million.
Never Jofris was remanded out of custody on US$300 bail when he appeared before Magistrate Francis Mapfumo.
The complainant in this case is the State represented by Detective Sergeant Karize of CID Suspects Harare.
The informant is Balwearie Holdings (Private) Limited, registered under company number 1898/20 and is being represented by one of its directors, Believe Guta.
Jofris is employed by Kukura Mining (Private) Limited as the organising manager.
It is the State’s case that during May 2020, in the matter held at the High Court of Zimbabwe under case number HC 2529/20, the accused person, with intent to mislead the court, submitted a false CR14 and attached an Opposing Affidavit knowing that the two documents did not truly reflect the facts.
It is alleged that notwithstanding such knowledge, the accused deliberately presented the documents as genuine and truthful with the intent of inducing the High Court to rely upon them in determining the matter before it.
The matter before the High Court of Zimbabwe on the day in question was to determine the actual owner of a piece of land measuring 97,0653 hectares in Kadoma that was registered under title deed number 4110 92.
The said CR 14 and opposing affidavit will be produced along with evidence clearly showing all the anomalies it bears.
It is alleged that due to the accused person’s actions, the informant suffered a potential prejudice amounting to US$3 000 000, whereas the State suffered prejudice to the proper administration of justice.
