A KEZI man, who could not stomach being ditched, raped his former lover and after quenching his sexual desires spat on her private parts accusing her of having a Sexually Transmitted Infection (STI), a court heard.
Sentencing Artwell Ndlovu, 22, of Simpane Village in Sun Yet Sen, regional magistrate Joseph Mabeza said Ndlovu was abusive to his ex-lover, 28, after termination of their love affair.
“The accused would at night force his way into the complainant’s house through the window, drag her outside to a nearby bush.
“He would start by assaulting the complainant with open hands, threaten her with an Okapi knife and rape her.
“On conclusion, he would spit on her privates and accuse her of being infected with HIV,” said Mabeza.
He said although Ndlovu had pleaded not guilty to the offence, he gave the court evasive evidence while the State had managed to prove its case.
Mabeza sentenced Ndlovu to 10 years saying rape cases were viewed in serious light by the courts as they traumatised women and put them at risk of contracting STIs.
The court heard that sometime in September last year, Ndlovu went to the complainant’s house where upon arrival he asked the complainant to open the door but she refused.
“Ndlovu then forcibly gained entry into the room through the broken window and while inside he asked the complainant to have sexual intercourse with him but she refused.
“He threatened the complainant with an Okapi knife and the complainant tried to escape but failed.
“Ndlovu got hold of her and dragged her to a bush, tripped her to the ground and had sexual intercourse with her without her consent,” said the prosecutor, Johannes Tlou.
After raping the complainant, Ndlovu threatened to kill her if she ever revealed what had happened to anyone.
The complainant complied and kept silent for a couple of weeks, fearing Ndlovu’s threats, but later reported the matter to the police leading to Ndlovu’s arrest.
