A Mhondoro man who slept with a mentally challenged woman after promising to marry her was sentenced to 12 years in jail. Forget Nyandoro (33) of Gopfa Village, Chivero, will however serve eight years after Harare magistrate Mr Hoseah Mujaya suspended four years on condition of good behaviour.
The complainant in her evidence-in- chief told the court that she consented to sexual intercourse after Nyandoro promised to marry her but was irked when he disappeared.
Prosecutor Mr Ephraim Zinyandu told the court that on April 10 this year around 2pm the complainant went to look for firewood in a nearby bush.
She used a pathway and saw Nyandoro who was riding a bicycle following her.
Nyandoro caught up with her.
He proposed love and started fondling her breasts.
The woman refused.
Nyandoro pulled her towards a big rock where he forced her to lie on it.
He then raped her.
After the sexual assault Nyandoro took off on his bicycle.
The complainant later told her mother about the sexual assault leading to Nyandoro’s arrest.
Meanwhile, two Harare men, who were part of a group of eight, appeared in court last Friday for allegedly taking turns to rape three women along a dirt road in Epworth and stealing their valuables.
Clever Nyachiwowo (20) and Denver Nevanji are facing rape and robbery charges, reports Prosper Dembedza.
They appeared before magistrate Mr Tendai Mahwe.
They were remanded in custody to September 2 and were advised to apply for bail at the High Court.
It is alleged that on August 16, the three complainants who were coming from Express Night Club at Overspill Shopping Centre, were attacked while walking along a dust road in Maseko.
The court heard that the duo and their six accomplices, who are still at large, pounced on the three women, pinning them to the ground.
The State, led by Mr Sebastian Mutizirwa, alleged that one of the attackers, only identified as Popi, ordered one of the victims to keep quiet as she knew him.
It is alleged that the rest of the gang took turns to rape the women before taking their undergarments.
It is alleged that Nevanji drew a knife and searched the women before robbing them of a cellphone and $65.
The following day, Nevanji and Nyachiwowo were arrested at Overspill Shopping Centre after one of the victims positively identified them.
