Gosha told the court that he could not continue paying maintenance fees when his children are begging for food in the streets.
“Everyday they come and eat at my house while I am paying their mother money for groceries. I intend to apply for custody of the children because their mother is using the money she is getting for maintenance for other things,” he said.
Gosha also told the court that his financial status has changed for the negative.
“My businesses are under financial threat and recently I was served with a letter of demand to vacate the premises after failing to raise rent.
“At some point I was also failing to pay the maintenance fees hence I cannot continue to be burdened with an amount I can no longer afford,” he said.
In response Chirombo told the court that Gosha is realising a lot of money from three shops he owns in the capital.
“He stole the children and went to Murewa where he photographed them. I reported the matter to the police and they ordered me to go and collect the children because he was just provoking me.
“This man is irked by the fact that I found another man and moved on. He once went to the headmaster of the school our child attends crying and begging him to help him get me back,” she said.
Magistrate Mrs Vongai Muchuchutu set the ruling for Monday.
