A CHILDLESS Victoria Falls man has told the court how he has endured insults from his workmates who mock him for failing to impregnate his wife.Nyasha Sithole approached the Civil Court seeking a peace order against about 30 members of the KoMbhoyi Curio Carvers’ Association.
He accused the chairman of the association Zachariah Mutomba, who however, chickened out of court and sent his deputy Fanuel Ncube to represent him.
He told the court that besides insulting him as being impotent, his workmates usually switch off his machine which has seen him failing to work.
“I want a peace order against these people. They dismissed me procedurally and. . . they switch off my machine each time I try to work. They always insult me saying I am a thief and impotent because I am married but don’t have a child. It is the chairman Zachariah Mutomba and Gift Chimbangwa who lead the insults saying I am not a man and I can’t bear children,” said Sithole.
Ncube disputed the claims saying Sithole had actually breached the association’s rules and went to court because he didn’t want to be disciplined.
“I can’t talk about the insults because I don’t know about that but we have never switched off his machine. In fact he was our treasurer and abused funds. We came to court where he was ordered to pay back the money. We also have rules which he has refused to follow which is why he claims he wants space to work from,” said Ncube in defence.
Sithole was a happy man after Victoria Falls magistrate Rangarirai Gakanje granted the peace order on Tuesday.
“The application for a peace order is granted and you must desist from insulting, disturbing him or switching off his machine for the next five years. If you have not been doing this you won’t be affected but if you are, it will affect you,” the magistrate said in her judgment.
She warned Ncube and his colleagues saying breaching the peace order would be committing a criminal offence.
“Be warned. If you want to remove him from the place do it legally if you feel you have a legal right to do so and follow the law than to take the law into your own hands. You can’t switch off his machine and pass on this message to Zachariah and other association members,” she said.
