Magistrate Tendai Manhanzva said it did not matter whether or not Mashiri repudiated his contract because the letter of acknowledgement of debt indicated the club owed him US$2 800.
“The secretary-general of Dynamos signed the letter of acknowledgement of the debt on the club’s behalf,” Ms Manhanzva said.
“If Mashiri did not participate in the CAF (competition), the secretary-general should not have included the amount on the acknowledgement of debt, the respondent ought to pay the applicant.”
Dynamos was ordered to pay the amount owing within seven days as well as interest at the prescribed rate from December 30, 2010 to the day of judgement. Dynamos had denied the letter of acknowledgement of debt, which was attached by Mashiri as evidence. They also argued that Mashiri couldn’t claim bonuses because he repudiated his contract prematurely and left before the club participated in the CAF competition.
