Former MDC-T chairman for Masvingo province Mr Bernard Chiondegwa had his furniture attached by the messenger of court over non-payment of a US$32 000 debt.Mr Chiondegwa, on behalf of his company Con Plant Technology, got a loan from Nelhurst Trading on March 24 2013, but failed to pay back. Nelhurst successfully sued to recover its money from Mr Chiondegwa.
Mr Chiondegwa had property attached on September 24 2014 and removed from his company’s Eastlea offices on October 30.
It includes four office desks, an executive desk, chairs and many other items.
Nelhurst advanced US$21 000 to Mr Chiondegwa’s company and in terms of the agreement, the debt was to be paid within 30 days.
The parties agreed on penalties and interest in the event of Mr Chiondegwa defaulting on repayments. After the penalties and interests were factored in, the debt ballooned to US$31 000.
Chiondegwa failed to settle the debt and a writ of execution was issued after it became clear that he had no capacity to pay back.
Meanwhile, Harare businessman Mr McDonald Chapfika has also lost property worth over US$21 000 after failing to pay back the same company.
When the sheriff went to his Glen Lorne premises along Enterprises Road for attachment, he was denied entry, but attachment was finally effected.
Harare lawyer Mr Tendayi Shomwe of Mambosasa Legal Practitioners represented Nelhurst in both cases, while Mr Catthew Manyani of TH Chitapi and Associates acted for Chapfika.
