Medical doctor attackers free for now…State withdraws the matter before plea

THE State has withdrawn before plea the matter involving two brothers who are seen in a viral video allegedly punching and kicking a medical doctor.
Prince Mugwagwa and his brother Nigel appeared on Wednesday morning before Bulawayo regional magistrate Mr Lungile Ncube. The pair were represented by their lawyer, Mr Simbarashe Innocent Madzivire of Mashayamombe Law Firm.

Prosecutor, Mr Sehliselo Khumalo told the court that the key witness is out of the country and they cannot proceed with trial.
“The key witness who saw the incident unfolding before him is in the United Kingdom. As such, we cannot proceed with trial. We are withdrawing the matter before plea,” said Mr Khumalo.

The magistrate then proclaimed that the charges had been withdrawn before plea.
Mr Khumalo told the court that on 05 April this month the Mugwagwa brothers were at Cotton Kraal Bar situated at Bradfield Shopping Centre and had a misunderstanding with Mkhonzeni Sibanda (40).
“They had a misunderstanding over an undisclosed issue. In the midst of that, Prince grabbed the complainant by the collar and rained fists on him.
They kicked him all over the body with booted feet. The Mugwagwa brothers were joined by two other unidentified men, who are on the run, in punching and kicking him,” said Mr Khumalo.
The complainant was rushed to hospital for medical attention. A medical affidavit will be produced in court as an exhibit.
