Motorist gets 6 months for culpable homicide

A MOTORIST from Zvishavane who ran over a pedestrian and killed him on the spot was yesterday sentenced to an effective six months in prison by Gweru magistrate Florence Nago.James Mbeure, 37, of 1151 Eastlea, Zvishavane, who fatally hit Reuben Mbikiza with his car, was convicted on his own plea of guilty to culpable homicide.

The matter was initially heard before the Zvishavane magistrates court before being forwarded to the Provincial Courts in Gweru.

Prosecuting, Bernard Nyoni said on February 11, 2013 at around 10PM, Mbeure was driving a Toyota Ipsum along the Gweru-Zvishavane Highway on his way to Zvishavane.

At the same time, Reuben Mbikiza was crossing the road from the west towards the east.

Mbeure hit Mbikiza with the vehicle’s right fender while he was walking along the left lane. He fell onto the tarmac and died on the spot.
Mbeure stopped after the collision and the body was taken to Shurugwi District Hospital for postmortem.

Nyoni said Mbeure was negligent in that he failed to keep a proper look out while driving.

He also told the court that Mbeure was driving at an excessive speed.
