TWO Mudzi siblings and their colleague have been convicted of murder for brutally assaulting a man they accused of stealing a cellphone during a beer binge in 2022.
Clever Mudzengere (24), Trymore Mudzengere (23) and Freddy Gireya (23) teamed up to assault the deceased on December 26, 2022, at Chikwizo Business Centre in Mudzi.
The trio accused the man of stealing their cellphone and left him mortally wounded resulting in his death a few hours later.
All the three are artisanal miners, and they denied the charge, but the State proved that they unlawfully and with intent to kill struck the deceased on the head with an empty bottle and stamped on his chest.
The court heard that the deceased was first struck with an empty bottle by Clever and collapsed.
Trymore and Freddy joined in the assault, kicking and trampling on him while he lay unconscious.
They all took turns to repeatedly stamp on his neck and chest while a mob watched at the shopping centre.
“The deceased who was mortally wounded died from his injuries a few hours later.
“A conclusion that each of the three accused participated in the crime puts the matter to rest.
“We were left with no apprehension that the prosecution managed to prove they all assaulted the deceased on the fateful afternoon.
“Accordingly, it is ordered that each of the accused persons is found guilty of murder as charged,” ruled Justice Munamato Mutevedzi.
The trio now awaits sentencing.
