THREE men who allegedly killed a Gwanda man over “boring” music yesterday appeared in court charged with murder.
The trio, Prince Ndlovu, 25, Paballo Dube, 22, and Bekithemba Vela, 23, all from Sengezane area were arraigned before magistrate Sheila Nazombe facing charges of murdering Elson Samuel Tirivavi, 22.

They were not asked to plead but were remanded in custody to May 19 and advised to apply for bail at the High Court.

Ndlovu did not have legal representation, while Dube and Vela were represented by McAllister Ncube of Mabhikwa, Hikwa and Nyathi Legal Practitioners.

Allegations by the State are that Tirivavi was killed in a misunderstanding over “boring” music at Tuli Training Centre in Guyu on Independence Day.

“On April 18 this year, Dube had a misunderstanding with Tirivavi and his cousin brother Misheck Chirwa resulting in a fight. Dube ran towards the training centre hall seeking assistance from Ndlovu and Vela,” said prosecutor Edward Ndlovu representing the State.

The court heard that Tirivavi followed Dube to the hall and was then assaulted. “The three started assaulting the now deceased, Tirivavi, who was following Dube. Dube and Vela assaulted Tirivavi with booted feet and a chair while Ndlovu struck him with an empty bottle on the forehead. Tirivavi sustained serious injuries,” the court was told.

He was ferried to Gwanda Provincial Hospital and later transferred to United Bulawayo Hospitals for medical attention.

Prosecutor Ndlovu told the court that Tirivavi died on April 26, a week after his admission at the hospital as a result of the injuries inflicted on him.
