A 19-year-old man from Soti village in Uzumba will spend one year in prison for incest after he slept with his 14-year-old sister.
Gift Muzori was charged for contravening Section 75 of the Criminal Law Code that prohibits sexual intercourse within a prohibited degree of relationship that is between persons who are closely related.
On Monday, Mutawatawa magistrate Mr Obedience Matare slapped Muzori with 14 months imprisonment but set aside two months on condition that he does not commit a similar offence in the next five years.
In January 2023, the court heard that the man asked his sister to get intimate with him.
The teenagers agreed to keep their affair a secret and had sex several times between January 2023 to September 2023.
The sexual relationship continued until their grandmother, Mrs Sekai Mashanga, discovered that the minor was pregnant.
When asked about the pregnancy, the minor divulged her sexual relationship with Muzori.
A report was made at Chief Chipfuyamiti’s court.
The traditional leader advised Mrs Mashanga to accompany the minor to Mutawatawa Police Station, where a report was made, leading to Muzori’s arrest.
During trial, Mr Matare said any man who abuses his sister is a danger to society.
Mr Steven Malota prosecuted.
Ordinarily, both parties should have been jointly charged for incest, however, the girl is still a minor, hence the exclusion on the charges.
The court is still waiting for the probation officer’s report before concluding the case.
The minor gave birth to a baby girl on April 28, 2024
