A MISUNDERSTANDING over a nickname between a Buhera nephew and his uncle ended tragically after the former fatally attacked the latter.
Philip Murimi (20) of Neshava Village under Chief Nyashanu has appeared in court facing culpable homicide charges as defined in Section 47 of the Criminal Law (Codification and Reform) Act, Chapter 9:23.
Murimi, who is out on bail, is represented by Rusape lawyer, Mr Maxwell Chiwanza of Chiwanza and Partners. He is denying causing the death of Steven Svova (30).
Rusape area prosecutor, Mr Tirivanhu Mutyasira, told the court that Murimi assaulted Svova all over the body resulting in him being hospitalised. He later succumbed to the injuries sustained from the assault.
“On January 29, 2015, Murimi and Svova were in the kitchen hut drinking traditional beer at Chimombe homestead when they had a misunderstanding over the nickname of the now deceased “Magagani”. Svosva insisted on calling him with the nickname but this did not go down well with the accused person.
“A misunderstanding arose resulting in Murimi pushing Svosva and he fell on the floor. Murimi proceeded to assault Svosva all over the body. Other villagers restrained the accused from further assaulting the now deceased. Svosva left the scene and went to his homestead.
“He was taken to Murambinda Mission Hospital by a relative on January 30, 2015 for treatment as his condition deteriorated. He died on the same day. The matter was reported to the police resulting in the arrest of Murimi,” he said.
The deceased’s body was taken to Parirenyatwa Group of Hospitals where a pathologist, Dr Mauricio Gonzalez, who did the post mortem concluded that the cause of death was subdural haematoma and head trauma.
The trial continues before regional magistrate, Mr Livingstone Chipadza on February 11.
