NSSA drags companies to court over debt

NATIONAL Social Security Authority (NSSA) has dragged three Bulawayo engineering firms to court for failing to settle a total accumulative debt of more than $80,000 in contributions accrued over an unspecified period.

NSSA, which is the plaintiff in the matter, this week filed separate summons at the Bulawayo High Court citing Williams Engineering Company, Dube Holdings t/a Rondebult Machines and Mini Castings as the defendants.

The social security insurer is demanding the sum of $22,193,81 from Williams Engineering. Rondebult Machines owes NSSA $49,328,13 while Mini Castings has a debt of $12,502,89 .

NSSA, through its lawyers, T Hara and Partners, said the three companies were registered employers of labour obliged to pay monthly contributions in terms of Statutory Instruments 68 of 1990 and 393 of 1993.

“The defendants have a legal obligation to pay monthly contributions before the 10th of every month in terms of SI 393 of 1993. As at the last date of inspection, the defendants had accrued arrears in the sum of $84,024,83,” said NSSA in its summons.

The social security insurer said the failure by the three companies to remit the contributions was a breach of their statutory obligation. In the court papers, NSSA is demanding that the three defendants pay the debt with a five percent interest per annum and cost of suit at attorney-client scale. The three firms have not yet filed notices to enter an appearance to defend.
