A NYANGA man, who sold his vehicle that was under attachment by the Messenger of Court, waiting for auction to cover his judgment debt, has been arrested and convicted for defeating the course of justice.
Trevor Saziya (39) of Nyangani Park appeared before Nyanga magistrate Notebulgar Muchineripi, facing one count of Obstruction of Messenger of Court as defined in Section 72 of the Magistrates Court Act Chapter 7.10, which makes it illegal to hinder a Messenger of the Court from conducting their lawful duties.
Saziya, who was not represented, pleaded guilty to the offence, and Muchineripi sentenced him to pay a US$150 fine to be paid by May 29 2026 and in default of the fine, he will serve an effective 30-day imprisonment.
Prosecutor Nyasha Sesenyai told the court that Saziya obstructed the Messenger of Court, Charles Makombe when he sold a Mercedes Benz that was attached for a US$4 080-00 he owed to a microfinance house.
“On September 11 2025 and at Nyanga Magistrates Court, a warrant of ejectment and execution against movable property was issued in favour of Qupa Microfinance Limited ordering the accused person and one Lovemore Saziya to pay a judgement debt of US$4 080-00.
“On September 27 2025, the accused person was procedurally served the notice of execution and his motor vehicle, a silver Mercedes-Benz registration number AFD 5409, was attached to settle the debt.
“On February 27 2026, the Messenger of Court proceeded to collect the motor vehicle to present it for auction, but he found out that the vehicle had already been disposed of.
‘‘The accused person acted unlawfully,” said Sesenyai.
