Julius Makumbe who is now blind and has difficulties walking, made a peace order application against his grandson Chamunorwa Makumbe who is staying at his house in Mufakose.
Julius was assisted in court by his son Fanuel who is Chamunorwa’s father. Julius told the court that he left his house in the custody of Fanuel when he retired and started staying in the rural areas.
“Chamunorwa doesn’t contribute towards payment of utility bills and this has led to other tenants vacating yet the house is my only source of income.
“Whenever I send my son to collect rent Chamunorwa assaults him and I now fear for my own son’s safety. When I came to Harare for medical attention Chamunorwa mocked me and told me to go back to the rural areas and resume herdman duties because the house belongs to him,” he said.
Julius asked Chamunorwa if by any chance he had sold the house to him.
“If I sold my house to him it means he owes me money. Does one not have rights over his property?” he said.
In his response Chamunorwa told the court that his grandfather had not sold the house to him but he was only looking after the property.
“I am in good books with my grandfather but my father is the one influencing him so that he can sell it since he already sold his,” said Chamunorwa.
Magistrate Tendai Manhanzva told the court that she was convinced Chamunorwa was taking advantage of his grandfather’s old and frail state.
“You are able bodied and capable of looking after yourself. You have no legal order to make you stay at this house therefore vacate the premises by July 31,” she said.
Julius who was staggering due to old age, left the court in stitches when he shouted that he wanted Chamunorwa to move out immediately.
“It is not proper to have him evicted today because he needs time to look for alternative accommodation,” magistrate Manhanzva said.
