Redcliffe Woman acquitted of killing son

Nomatter Gwatsvaira of Redcliff has been acquitted of murder, with the High Court citing her mental illness at the time of the fatal incident.

Justice Pisirai Kwenda acquitted Gwatsvaira at the High Court Circuit in Gokwe after it was established that she was mentally ill when she killed her one-year-old son, Brighton Makai.

Gwatsvaira inflicted fatal injuries on her son while lying on a bed with him on August 22, 2020.

She scratched Brighton’s navel and stomach before forcefully pulling his genitals, resulting in his tragic death.

Justice Kwenda invoked Section 29 (2) (a) of the Mental Health Act [Chapter 15:12], which provides for acquittal on the grounds of insanity.

The court said Gwatsvaira’s actions were not intentional but were a result of mental disturbances.

The infant’s grievous injuries were discovered by Gwatsvaira’s sister, Sarudzai, who found him groaning in pain with a bruised navel and missing private parts.

Brighton was rushed to Kwekwe District Hospital and was pronounced dead upon arrival.

Justice Kwenda ordered Gwatsvaira’s referral to Mlondolozi Rehabilitation Centre, where she will receive psychiatric care and support.

The prosecution was led by Ms Salome Maunganidze.
