Ruling on application for exception by Borrowdale duo deferred

Harare magistrate Mrs Sharon Rakafa has deferred to September 18 her ruling in another application for exception by two Borrowdale men who erected a billboard denouncing a property development company.

This was after the defence apologised to the court saying his new clerk had filed their heads of argument at the wrong court.

Mark Strathen of Paragon Printers and Grant Russell of Fairclot Investments who are facing criminal nuisance charges filed their heads of argument today and the State undertook to respond next Monday.

Mrs Rakafa then deferred the ruling to September 18.

The duo made their first application for exception while being represented by Mr Tendai Biti and it was dismissed.

The Supreme Court recently dismissed the duo’s appeal against a High Court judgment ordering them to proceed to trial.
