Rusape man jailed two years for culpable homicide for causing fatal Harare-Mutare Highway accident

A 22-year-old Rusape man has been jailed for two years and his driver’s licence suspended for one year after he was convicted of culpable homicide.

Liberty Horacio was responsible for causing a fatal road accident along the Harare-Mutare Highway that claimed the life of a motorcyclist.

According to a statement by the National Prosecuting Authority, a Rusape Magistrates’ Court convicted Horacio of culpable homicide for causing the accident, which occurred on May 25 this year at around 5:30 am.

The court heard that Horacio, who was driving a brown Honda Fit with two passengers on board, encroached into the lane of oncoming traffic near the the 197km peg and collided head-on with an unregistered motorcycle.

The rider sustained severe head injuries and fractures, resulting in his death. The court found Horacio to have been negligent by driving at excessive speed, failing to keep a proper lookout on the road and act reasonably to avoid the collision.

He was sentenced to 30 months in prison, with six months suspended on condition of good behaviour. He will serve an effective 24 months in jail, while his driver’s licence was suspended for 12 months.

The NPA said, “The case highlights the dangers of reckless driving and the

need for strict adherence to road safety laws to save lives.”
