Rushwaya withdraws request

to the Supreme Court.

Rushwaya, who since the trial started was raising constitutional issues in the manner the case was being handled, now wants to lodge an application for a discharge at the close of the prosecution case.

Her lawyer, Mr Charles Chinyama told Chitungwiza magistrate Ms Estere Chivasa that his client intended to withdraw their letter to the superior court.

In place of the letter, Mr Chinyama said that he would file the application for discharge by this Friday with prosecutor Mr Sidom Chinzete expected to respond on the matter on June 21.

Ms Chivasa remanded Rushwaya to July 1 for the ruling. Rushwaya once applied to have her matter referred to the Supreme Court arguing that her arrest by the Zimbabwe Anti-Corruption Commission was an infringement of her constitutional rights.
This resulted in the court postponing the ruling on three occasions.
