evidence to justify keeping him on remand
Mushayavanhu (38) appeared before magistrate Mr Donald Ndirowei who removed him from remand after his lawyer, Mr Henry Paul, made an application for refusal of further remand.
Mr Ndirowei ordered the State to proceed by way of summons should it find enough evidence to present a reasonable case.
The State led by Miss Junior Mugebe had applied for a further postponement of the matter to allow finalisation of investigations but Mr Ndirowei ruled that there was inordinate delay.
He said the State had been given enough time to finish investigations.
Mr Ndirowei granted the defence’s application after hearing arguments from both counsels.
It was alleged that sometime in April last year Mushayavanhu was scheduled to attend a finance sub-committee meeting in Gweru and Zimbabwe International Trade Fair in Bulawayo.
Mushayavanhu claimed 50 litres of petrol worth US$71.50 from Ruwa Local Board for the purpose of the trip. It was alleged he did not attend the meetings and failed to return the fuel. Mushayavanhu, it is alleged, was scheduled to attend a Mayors’ Forum in Beitbridge and got US$855 in allowances but di not travel.
