‘She is a man’ court told

The siblings reside at number 26 Morton Jaffray Road in Eastlea.
Before Leo could divulge the reasons why she made the application, Marvin intercepted and told the court that Leo was not a she.

“Your Worship, he is actually a man,” he said.
“If possible please, grant us a reciprocal protection order because he is also causing me emotional stress.”

But Leo chided her brother and told magistrate Ms Vongai Muchuchuti that she was a woman as indicated in her application.
She said her brother always caused problems after drinking and looks at her “weirdly” after each time he took some alcohol.

“He is violent and keeps interfering with my private life,” said Leo.
“He intimidates me and my younger brother. When he comes home drunk we can hear him swearing from afar on the road we stay in, swearing that he will get violent towards me,” she said.

The court heard that the Marvin disturbs his parents from sleeping once he comes home drunk.
“My parents cannot control him and there is no peace in the home,” said Leo.

“He goes around telling lies about me. He also threatened my puppy which is six months old. He is so unpredictable.”
In his response Marvin insisted that he needed to be protected against Leo, whom he continued to refer to as a man.

“Am I also allowed to get a protection order against him?” he said.
“He is also abusive towards me.”
Ms Muchuchuti granted the protection order in favour of Leo and advised Marvin to make his own application against her if he so wished.
