Ndambakuwa (52) is facing two counts of fraud and three of theft involving over US$49 000.
Prosecutor Mr David Magwegwe told presiding magistrate Ms Anita Tshuma that the State was withdrawing the charges before plea and will proceed by way of summons when the docket is ready.
He furnished the court with a letter of authority from the Attorney General’s Office.
“Charges before you have been withdrawn before plea at the insistence of the State,” Ms Tshuma said.
Ndambakuwa who is among other legislators arrested for abusing CDF funds becomes the second Member of Parliament to have charges withdrawn before plea after Bulawayo legislator, Albert Mhlanga (MDC) had his charges withdrawn.
Other MPs who are still before the courts on the same charges include St Mary’s legislator Marvellous Khumalo and Kariba legislator Cleopas Machacha.
It is alleged that on September 30 2010, the Magunje constituency committee opened an account with Agribank.
During the period extending from November 1 to December 29, 2010, Treasury transferred US$50 000 in three batches into the account.
It is alleged Ndambakuwa spent the money on personal needs and did not use any for projects in his constituency.
