Matapo, Ruperts Chimanga, Phillip Chivhurunge, Lucky Mhungu, Bigknows Wairesi and Sairezi Shonhiwa are facing charges of attempting to break out of Chikurubi Maximum.
Matapo and Mhungu early this year made an application to have their case referred to the Supreme Court arguing that their rights were being infringed.
Yesterday Matapo’s lawyer Mr Charles Warara intended to make yet another application for stay of prosecution pending the outcome of an application they made at the Supreme Court.
However, presiding regional magistrate Mr Morgen Nemadire said the trial could not be delayed by the Supreme Court application.
“We must make progress in this matter, we will not entertain any unnecessary applications . . . to do with naked stripping it does not have anything to do with the court, it is administrative if all prisoners are being searched they should also be searched.” – CR.
