A Bulawayo woman claimed that she had been raped after a night of carnal pleasure with her boyfriend which resulted in her private parts swelling.
Thandekile Maphosa and Bernard Ndlovuas relationship is on the brink of collapse following Maphosaas fabricated rape claim against him.
Maphosa appeared before Bulawayo magistrate Stephen Ndlovu at the Western Commonage Magistrates Courts on Friday last week and was charged with a single count of making a false report.
According to the State outline, Maphosa reported the supposed rape to the police claiming that Ndlovu, a pirate taxi driver, raped her when they were driving to Pumula South where she resides. She told the police that Ndlovu pulled over along the way and raped her.
During the trial, Maphosa told the court that she had begun to suspect that Ndlovu was cheating on her and was convinced this was true after the swelling of her private parts following their a?sexcapadea? in Ndlovuas Honda Fit.
In a fit of rage, Maphosa then reported the false rape to the police whose investigations revealed that she had not been raped, but was having an affair with Ndlovu and had consensual sex on the night in question. Maphosa was subsequently arrested and charged with making a false report.
She was convicted on her own plea of guilty and sentenced to six months in prison, of which three months were suspended on condition that she does not commit a similar offence in the next five years. The magistrate ruled that the remaining three months be commuted to 105 hours of community service.
a?I was having trouble walking as my privates were swollen after I had sex with my boyfriend Bernard whom I thought was cheating, so I told the police that I had been raped,a? Maphosa told the court.
Maphosa also told the court that she had fabricated the claims after getting into trouble with her mother for arriving late at home.
